Thompsons Solicitors A note on making a legal claim from Thompsons Solicitors

It is important that you seek expert advice when making a claim. You may be entitled to compensation from the Benefits Agency or from former employers.

Clydebank Asbestos Group have worked closely with the other asbestos groups in Scotland as well as Frank Maguire of Thompsons Solicitors along with his team in order to get compensation for victims.  Over the years, claims have been made for pleural plaques and pleural thickening, diffuse pleural thickening, asbestosis, lung cancer caused by asbestos and mesothelioma. 

Pleural plaques claims are on hold at the present time pending an appeal before the House of Lords in England.  If you have been diagnosed with pleural plaques, it is important to contact us immediately though because time limits still apply.

Claims are continuing to be fought strenuously.  In relation to mesothelioma claims, after much campaigning we are pleased to advise that if someone now dies from mesothelioma and they settle their claim during life then their family can still have a clam after their deaths.  Until December 2006 that was not the case.  We can now push for compensation for a man or a woman that is dying of mesothelioma safe in the knowledge that their loved one can still make a claim afterwards.

The law has also changed with regards to certain relatives that can claim if the victim has a terminal asbestos condition.  This now includes brothers and sisters, parents and grandchildren as well as spouses and children who were previously able to claim.  In-laws can no longer claim. 

We continue to fight to improve damages for victims of asbestosis and pleural thickening.  The pleural plaques House of Lords’ appeal takes place on 7th June 2007 and we will be monitoring that situation to consider the best way forward for those that have pleural plaques.

We continue to fight for Industrial Injuries Disablement Benefit for all our members and clients that have an asbestos condition.  We are always mindful of the tactics constantly being developed by insurance companies and with our colleagues in the other asbestos groups and at Thompsons Solicitors we are always trying new tactics to defeat the campaigns which try and minimise compensation to victims.

We have fought in Scotland for justice and that means the best damages available in the United Kingdom.  Damages are now much higher in Scotland than in England and we have led the way in achieving that situation and we will continue to do so in the future.

Compensation issues are often complicated and can take a long time to resolve. If you were a member of a Trade Union, they may also be able to help you.
